Biography

Joe Merschman represents clients in complex litigation and arbitration. He is one of only three lawyers in Connecticut named to Benchmark Litigation's inaugural "Under 40 Hot List," which is awarded to lawyers age 40 and under for their achievements in the legal profession. The Connecticut Law Tribune named Joe a "New Leader in the Law" in 2015, New England Super Lawyers recognized him as a "Rising Star" in Business Litigation (2014) and Class Actions (2015), and he has consistently received the highest "AV Preeminent" peer review rating by Martindale-Hubbell. Joe has experience representing clients in a wide range of high-stakes litigation, including securities class actions, contract claims, business torts, unfair trade practices, shareholder derivative litigation, and other business disputes. Joe represents multi-national corporations, privately-held companies, and individuals across many industries, including financial services, construction, technology, pharmaceutical, and health care.

Joe is Co-Chair of the Securities Litigation Subcommittee of the American Bar Association's Commercial & Business Litigation Committee, and he is on the Editorial Board of the Committee's quarterly newsletter. Joe also serves on the Executive Committee of the New Haven County Bar Association, and is a member of the Connecticut Bar Association and the New Haven Inn of Court.

Joe clerked for Connecticut Supreme Court Justice Christine S. Vertefeuille and for U.S. District Judge Richard W. Roberts in Washington, D.C.

Joe graduated with Honors from the University of Connecticut School of Law, where he was an Articles Editor on the Connecticut Law Review.

Notable Cases

  • Lead counsel for a financial services company and its senior executives in a federal securities class action and related derivative lawsuits regarding the company's disclosures to investors.

  • Represented a technology company in arbitration against the purchaser of its business line for failing to make milestone and royalty payments under the asset purchase agreement. Obtained a confidential settlement shortly before the arbitration hearing.

  • Represented the former Chairman and CEO of a nationwide construction company in a lawsuit over the company's failure to pay him certain bonuses. Obtained a confidential settlement.

  • Defended a bank in a federal class action and related lawsuits that alleged it was liable for losses in Bernard Madoff's Ponzi scheme. Three cases settled on favorable terms at the start of jury deliberations and the fourth case resulted in a defense verdict.
  • Represented a global pharmaceutical company in a products liability lawsuit. Received summary judgment in favor of the company.

  • Defended a broker-dealer in a lawsuit alleging it was liable for losses caused by a registered representative's outside business activity. The case was dismissed.

  • Other notable cases include: representing a non-profit company in a lawsuit challenging the denial of a property tax exemption; representing a property owner in a dispute with an architect over construction plans; and defending a corporation in environmental litigation over the alleged pollution of a former manufacturing site.

Significant Pro Bono Matters

  • Appointed by the federal court to represent an inmate in a civil rights lawsuit accusing prison officials of deliberate indifference to his safety and facilitating an attack by other inmates. Negotiated a significant settlement on the eve of trial after obtaining sanctions against the defendants for destroying evidence.

  • Successfully represented a refugee from war-torn Sudan in a claim for political asylum.
