Environmental Health and Safety

Our environmental, health and safety (EHS) attorneys, including a former corporate EHS professional, provide practical and tailored advice and counsel across a broad spectrum of EHS-related matters, including advising clients with respect to environmental permitting and remediation; cost-effective representation in cost-recovery and other environmental litigation; and counseling in governmental investigation and enforcement actions.  We serve as national EHS counsel to companies in various industries and strive to integrate our service offerings so as to align with our clients’ business objectives. We assist clients in developing workable strategies and sustainable programs to comply with applicable Occupational Safety and Health Administration (OSHA), U.S. Environmental Protection (EPA) and state-specific EHS requirements.  Having experience with a diverse array of industries and business sectors, including, among others, retail grocery and pharmacy, petrochemical and renewable fuels, power generation, aerospace, outdoor accessories, industrial manufacturing, warehousing and distribution, and firearms, our EHS lawyers are well versed in preparing for and responding to the many facets of governmental inspections and/or enforcement actions.  We frequently serve as defense counsel in cases involving alleged EHS violations and assessment of penalties by OSHA, EPA and, as applicable, state agencies.

Our EHS lawyers partner with clients to address day-to-day EHS compliance issues.  Representative engagements include the development of EHS policies, programs and training and advising on occupational health issues relating to industrial hygiene and employee exposure, as well as a broad range of occupational safety issues, including among many others, hazard communication, electrical safety, fall protection, and machine guarding.

We frequently counsel clients on issues relating to air emissions, wastewater discharge, stormwater, and regulated waste permitting, assisting clients in connection with, among other issues, initial permit applications, modification applications and permit transfer requests.  We routinely work with clients to evaluate and address EHS risks in business and real property transactions, including assisting with pre- and post-closing EHS permitting and compliance issues and, as necessary, the investigation and remediation of environmental conditions.
