Enforcing Judgments against Foreign Debtors in the U.S.

The panel will address the Separate Entity Rule, which provides that each bank branch is a separate entity for post-judgment restriction of the assets of a judgment debtor. The rule impacts those successful plaintiffs seeking to collect judgments entered against foreign defendants or U.S.-based defendants with substantial assets outside of New York. Two recent federal court rulings have questioned the validity of the rule, creating a conflict with New York's state courts that might allow a judgment creditor to use New York's federal courts to attach assets held outside the country.
