6-S Trademark Licensing Best Practices: Negotiating the Contract and Implementing the Deal
This workshop will educate the less experienced, and invite comment from the more experienced, as we discuss from both a licensor's perspective and a licensee's perspective best practices: (1) when negotiating a trademark license and (2) to build the relationship once the contract is signed. Mary Norris and Myung Kang-Huneke will identify key license terms that licensors and licensees invariably negotiate, and will offer some standard and not-so-standard approaches to reaching satisfactory resolutions. Myung will comment on and tell war stories about her experiences in dealing with these provisions and their practical consequences from the licensor's perspective, and Mary will do the same, from the licensee's perspective. Mary and Myung will then provide tips for maintaining and building a strong relationship while performing under the license, including "Dos and Don'ts" of licensor/licensee interactions.
