The Trouble with Workplace Email, Text Messages and Social Media
In today's society, e-mail, text messaging and social media are, for better or for worse, the primary means of communication. The workplace is no exception. This session will focus on the challenges employers face as a consequence of employees' pervasive use of electronic communications to interact with colleagues, customers, and the outside world at large. You will hear examples of email, text message and social media "horror stories"; learn about the potential legal pitfalls associated with regulating and monitoring employees' electronic communications; be provided with recommended policies relating to employee privacy rights and expectations, as well as document retention and destruction, including for e-discovery in litigation; and receive tips for safe electronic communication.

The Must-Haves for Employer Immigration Compliance
Immigration compliance is a hot topic under the Obama Administration, and the government has been focused on enforcing laws and imposing penalties on employers (which leads to bad press and other unfavorable consequences) through increased immigration inspections at places of business. This session will address the following "Must Haves" for employers recruiting and hiring foreign national workers: pre-employment inquiries under the Immigration Reform and Control Act (IRCA); necessary employment policies regarding visa sponsorship and associated fees; best practices for I-9 compliance; and understanding E-Verify and social security no-match letters. We will also provide an overview of common employer-sponsored work visas.

Learn how the performance review process can help or harm your organization in litigation avoidance and defense. During this session, we will present detailed do's and don'ts in addressing how performance management means much more than the annual review; why ongoing performance management is critical; the common mistakes that encourage claims, as well as compromise the organization's defense when claims are brought; and conversely, the ways in which your organization can use the performance management process to deter claims and enhance its defenses in litigation.
