Wiggin and Dana Partner Quoted on WNPR

New Haven – Wiggin and Dana Litigation Partner and co-chair of the Franchise and Distribution Practice Group, Bethany Appleby, was interviewed by Harriet Jones on the August 6, 2012 WNPR radio broadcast "Hit By Recession, Franchising Hopes to Bounce Back." The broadcast discusses the impact the recession has had on franchised companies, the relationship between the franchisor and franchisee, and the legal aspects of owning a franchise.

"Because I'm a litigator, I tend to see the litigation when it arises, but it seems fairly inevitable that if you're a successful franchisor, you have locations throughout the country, you're going to see some sort of litigation," said Appleby. When Appleby was asked what the most contentious item is between franchisors and their network of businesses, "it's royalty payments, and a struggling franchisee who either chooses not to pay royalties because they're unhappy in some way with the franchisor, or can't pay royalties."
