Wiggin and Dana Wins Key New York Appeal for The Hartford

Wiggin and Dana successfully represented The Hartford in an important appeal involving a law firm's notice obligations under a malpractice insurance policy. The Appellate Division of the First Department, covering Manhattan, held that the insurer was relieved of its obligation to defend or indemnify its law firm insured when the law firm failed to notify the insurer that it had not sued the correct defendant before the expiration of a statute of limitations, when the court concluded a law firm should know that it may later be subject to a claim. Appellate group chair Jonathan Freiman represented The Hartford with associate Tadhg Dooley.
