Wiggin and Dana Secures Win for The Hanover Insurance Company and Zurich American Insurance Company in Class Action Cases
Wiggin and Dana Partner Michael Menapace and Associate Rachel Canna recently secured a win for Wiggin and Dana’s clients, The Hanover Insurance Company and Zurich American Insurance Company, against MSP Recovery Claims Series LLC in two class action cases.
In separate actions, MSP Recovery sued The Hanover Insurance Company and Zurich American Insurance Company seeking a pure bill of discovery and a declaratory judgment. MSP Recovery was seeking the production of years of the insurers’ claims files and changes to the insurers’ claims practices related to Medicare and Medicaid recipients.
The Florida state court granted a motion to dismiss. The decision holds that MSP Recovery had not satisfied the requirements of the Florida long-arm statute and, therefore, failed to demonstrate that the court had personal jurisdiction over these defendants.
