Partner Michael Menapace Quoted in Connecticut Law Tribune on Data Breach Class Actions
On July 10, 2024, Partner Michael Menapace was quoted in the Connecticut Law Tribune article titled, “44 Class Actions: Lawsuits Are Flying Over a Data Breach. But Can They Succeed?”
Michael explains, “Many times, the consumer class actions donโt get very far because one of the threshold issues is for the consumer to show actual injury, and thatโs a difficult thing to show. Itโs hard to show a direct line between a breach and how theyโve been injured.” Michael advises companies to develop a game plan for potential data breaches and said, “The preparation of having good data practices in place, having the incident response plan and practicing it, and having the cyber insurance in place is key.” He continues, “If a company that has been breached is hoping to recover from the bad actor directly, while thereโs nothing stopping them from trying that, itโs very unlikely, which is one reason why companies need to do everything they can to mitigate the risk.”
