Partner Paul Tuchmann Quoted in Politico Article on Bribery Case Against Former Lt. Gov. Brian Benjamin

On February 23, 2024, Partner Paul Tuchmann was quoted in the Politico article titled, “Case against ex-LG could get dropped.”

Commenting on the death of a key witness in the bribery case against former Lt. Gov. Brian Benjamin, Paul says that the U.S. Attorney for the Southern District of New York may have to drop the case. Paul continues, โ€œItโ€™s hard to see how they would have sufficient evidence to put in front of a jury on the bribery charges. Theoretically, the government could always find additional proof, but in this case, itโ€™s hard to imagine what the other evidence would be.โ€

In regards to the government nevertheless maintaining its appeal of a lower courtโ€™s decision to dismiss the bribery charge even before the witnessโ€™s death, Paul says that the judgeโ€™s ruling dismissing the charges against Benjamin is a bad precedent for the government, one that could make alleged government corruption even harder to prove in court.
