Wiggin and Dana Secures Win for Zurich American Insurance Company in COVID-19 Business Interruption Case

On January 26, 2024, Wiggin and Dana Partners David Roth, Jeffrey Babbin, and Michael Menapace secured a win for Wiggin and Dana’s client Zurich American Insurance Company against a large Atlantic City casino, AC Ocean Walk, LLC, in a COVID-19 business interruption insurance coverage dispute. The decision holds that business losses arising from the COVID-19 pandemic are not “direct physical loss of or damage” to insured property within the meaning of commercial property-insurance policies like the one issued to AC Ocean Walk.
