Partner Michael Menapace Quoted in Inside P&C and Insurance Insider on a Louisiana COVID-19 Decision

On June 23, Partner Michael Menapace was quoted in an article titled, “Louisiana Covid BI ruling seen as outlier, NJ court reverses similar decision.” The article appeared in both Inside P&C and Insurance Insider and covers a ruling by a Louisiana appeals court in favor of a New Orleans restaurant seeking business interruption coverage for forced closures due to the state’s COVID-19 lockdown measures. Notably, this ruling counters all similar appellate rulings on this issue.

Michael provided his thoughts on the likelihood of this ruling impacting similar cases in the state explaining, “It’s not precedential because of Louisiana Code, and not binding on federal courts applying Louisiana law.”
