Wiggin and Dana Attorneys Obtain Defense Verdict in Medical Malpractice Case

On February 28, 2020, Wiggin and Dana’s Erika L. Amarante and Catherine Baiocchi obtained a defense verdict after a two-week jury trial in a medical malpractice case in Bridgeport Superior Court.  The case alleged battery, lack of informed consent, and negligent infliction of emotional distress against a gynecologic oncologist arising from a post-operative examination following a procedure to remove pre-cancerous cells.  Plaintiff admitted that she consented to the post-operative pelvic examination; however, she alleged that there was a substantial and material change in circumstances during the pelvic exam that required her gynecologic oncologist to get additional informed consent. For damages, the case alleged continuing physical pain and an exacerbation of pre-existing mental conditions, including anxiety and post-traumatic stress disorder. The jury deliberated for three hours before returning a defense verdict on all three claims.
