Supreme Court Update: October Term 2025

On October 9, please join Partners Tadhg Dooley and David Roth, authors of Wiggin and Dana’s Supreme Court Update blog, for a preview of the Supreme Court’s October Term.

The discussion will include:

A look back at the defining decisions of the October Term 2024, including:

  • Trump v. CASA (holding that universal injunctions exceed the equitable authority of district courts);
  • United States v. Skrmetti (holding that a state ban on puberty blockers and hormone therapy for transgender youth does not violate the Equal Protection Clause); and
  • Mahmoud v. Taylor (holding that introducing “LGBTQ+-inclusive” texts into school curricula without providing for religious opt-outs likely violates the First Amendment).

Key cases to watch in the October Term 2025, such as:

  • Trump v. V.O.S. Selections (whether the President’s “Liberation Day” tariffs exceed statutory authority);
  • Chiles v. Salazar (whether a state law banning “conversion therapy” violates the First Amendment);
  • West Virginia v. B.P.J. (whether state laws prohibiting transgender athletes from participating on girls’ sports teams violate Title IX or the Equal Protection Clause);
  • National Republican Senatorial Committee v. FEC (whether limits on coordinated party expenditures violate the First Amendment); and
  • Louisiana v. Callais (whether the Voting Rights Act’s requirement that states account for disparate impact in the creation of legislative districts violates the Fourteenth or Fifteenth Amendments).

An examination of the Court’s use of the “shadow docket” (or “emergency docket”), where it has increasingly reviewed, and frequently vacated, lower court orders enjoining actions of the Trump administration on an expedited basis, often without fully explaining its decisions.
