Client Briefing: Labor and Employment Update
| The COVID19 pandemic has likely triggered some indefinite changes in the workplace, and statutory protections that continue through year end and beyond. Employers are faced with multiple questions, such as: who can or should maintain a remote working arrangement; ways to ensure the safety of essential workers, as well as those workers who may not be essential, but who wish to return to the workplace; what obligations are owed to workers with underlying conditions or those who are just reluctant to return; what are the ongoing statutory entitlements for workers who cannot or who do not wish to return to work; and what types of medical testing, if any, are we permitted to conduct on returning workers? In this two-hour presentation, Wiggin and Dana Employment attorneys will address these vexing questions and more. 8:30 a.m. – 9:15 a.m.: In this segment we will address issues relating to remote working arrangements, including ADA accommodations, wage/hour issues, and medical testing of returning workers. We’ll also touch on the types of claims already being raised by employees during the pandemic. 9:15 a.m. – 9:25 a.m.: Break 9:25 a.m. – 10:00 a.m.: An update on developments in wage and hour law, including newly issued opinion letters by the Department of Labor. 10:00 a.m. – 10:30 a.m.: This segment will focus on the Department of Labor’s proposed joint employer and independent contractor regulations, and the impact of this guidance on “Gig Economy” workers. |
