On October 4, the Summer 2024 issue of the Franchise Law Journal, Volume 43 Number 3, was published, where Litigation Partner John Doroghazi is Editor-in-Chief. The Franchise Law Journal is published by the American Bar Association Forum of Franchising. This edition covers Arbitration Waviers in the Wake of Morgan v. Sundance, authored by Wiggin and Dana Associates Rachel Canna and Jared Lincoln, on how courts have dealt with the important issue of what constitutes waiver of an arbitration agreement following the Supreme Court’s changing of the waiver standard two years ago. The second article is a fulsome overview of issues of advertising and speech in Speak for Yourself: Franchises, Advertising, and Speech. The third article provides advice on what to do when the franchise relationship is struggling in Alternatives to Termination: Effective Means of Facilitating Compliance or Merely Delaying the Inevitable? The final article addresses the often overlooked doctrine of third-party beneficiaries and its effects in franchising, in Franchisees as Third-Party Beneficiaries to Franchisor’s Agreements with Other Franchisees or Vendors.
