Order List

March 1, 2004

Greetings Court fans!

Not much to report today; just three grants from the order list:

1. Johnson v. California (03-636): This is an equal protection challenge to California’s policy of segregating prisoners by race in the initial days of their incarceration. The Ninth Circuit upheld the policy.

2. Crawford v. Martinez (03-878): This is another case challenging the applicability of the Supreme Court’s decision in Zadvydas v. Davis (2001) to Mariel boatlift Cubans, and so the Court consolidated it with Benitez v. Wallis, to be argued in April.

3. Florida v. Nixon (03-931): This is a death penalty appeal. After telling Nixon of his strategy, Nixon’s attorney admitted that his client was guilty in the hope that his candor would persuade the jury to spare his life. The strategy failed, and now Nixon claims that his attorney was ineffective. The Court will decide.

That’s all for today. Look for opinions tomorrow or Wednesday. Until then, thanks for reading!
