Jody Erdfarb and Andie King Contribute to AHLA’s Updated HIT Enforcement Summary Tables
Partner Jody Erdfarb and Associate Andie King have contributed to the American Health Law Association’s (AHLA) newly updated Health Information and Technology (HIT) Enforcement Summary Tables, developed by AHLA’s Health Information and Technology Practice Group.
The tables focus on U.S. Department of Health and Human Services Office for Civil Rights (OCR) and Federal Trade Commission (FTC) enforcement actions imposed on covered entities and business associates in relation to the Health Insurance Portability and Accountability Act (HIPAA) and/or Section 5 of the FTC Act. Covering actions since July 2008, the OCR and FTC tables summarize the following:
- Nature of the breach or violation.
- OCR’s or FTC’s findings.
- Corrective action plans or terms of orders.
- Resolution and/or the civil money penalty amount imposed on the entity.
Companion tables cover state attorney general enforcement actions and criminal prosecutions for HIPAA violations. Together, the four tables give compliance officers and health information professionals a practical reference for assessing risk, benchmarking enforcement trends, and strengthening compliance programs.
