Invalidity of VirnetX Patents Confirmed on Appeal and Apple Infringement Verdict Vacated

On March 30, 2023, the Court of Appeals for the Federal Circuit affirmed the Patent Trial and Appeal Board’s (PTAB) finding that the claims of two widely asserted Virnetx security patents were invalid and on March 31, 2023, vacated a $576 million judgment against Apple for infringing the two patents. Michael Kasdan was on the original team that successfully invalidated the two patents in Inter Partes Review proceedings before the PTAB on behalf of their client, Mangrove Partners in 2020.

In its March 31 Order, the appeals court said the judgment against Apple following a 2020 jury trial in the Eastern District of Texas cannot stand because the claims Apple was found to have infringed were declared anticipated or obvious and that finding was now confirmed on appeal.
