Partner Jolie Apicella Quoted in Healthcare Risk Management on the False Claim Act’s Expanding Reach
Partner Jolie Apicella was quoted in the May 2024 Issue of Healthcare Risk Management.
In the article titled, “Compliance Requirements Continue to Change, Need Close Attention,” Jolie says, “There is a prevalent sense that the False Claims Act’s (FCA) reach continues to expand.” Jolie advises clients to conduct due diligence not only at the outset of third-party engagement, but throughout that relationship. She continues, “Otherwise — and this is reflected in FCA settlements and qui tam complaints — companies can be on the hook for the bad conduct of its third-party vendors when that company knew or should have known about that conduct.”
Jolie also provided commentary on DOJ’s cybersecurity initiative and incentives for self-disclosures as well as Medicare Advantage settlements.
