Partner Jolie Apicella Quoted in Media on Advocate Christ Medical Center v. Becerra
On November 8, 2024, Partner Jolie Apicella was quoted in the Inside Health Policy article titled, “SCOTUS Justices Quiz HHS Over SSI Counting In DSH Calculation Case.”
Regarding Supreme Court justices challenging the federal government in Advocate Christ Medical Center v. Becerra, which focuses on how CMS calculates its DSH formula, Jolie explains that justices could cite June’s Loper Bright v. Raimondo ruling in their final decisions and believes the decision in Loper Bright might be one of the reasons why SCOTUS took up Advocate Christ in the first place.
Also on November 8, Jolie was quoted in the Axios article titled, “Billions at stake as SCOTUS takes up hospital case.” Commenting on the disproportionate share payments that have steadily declined in recent years but remain a lifeline for hospitals that treat a substantial number of poor patients, Jolie says, “While some hospitals are getting bigger and richer because of mergers, other hospitals struggle.” She continues, “The medical profession is under a lot of pressure to make profit at a time where there’s a lot of low-income patients that need care.”
