Partner Paul Tuchmann Quoted in Law360 on Eric Adams Federal Corruption Case Strategy

February 28, 2025

On February 27, 2025, Partner Paul Tuchmann was quoted in the Law360 article titled, “How Adams’ Latest Move Might Checkmate The DOJ.”

In response to New York City Mayor Eric Adamsโ€™ recent motion to dismiss the corruption charges against him with prejudice, Paul says, โ€œIt is a smart move on the part of Mayor Adamsโ€™ lawyers to file thisโ€ motion because it formally puts before the Court out-of-court statements made by Attorney General Bondi and her senior staff criticizing the case, which โ€œundercut the governmentโ€™s stated rationale in court for why dismissal without prejudice is appropriate.โ€

Paul further explains that the Justice Department also could, theoretically, reverse course on its motion to dismiss without prejudice and opt to continue the prosecution, but again that would be challenging because of the statements from Bondi, her Chief of Staff Chad Mizelle, and Emil Bove. Therefore, Adamsโ€™ attorneys โ€œmade the strategic choice to get this issue before Judge Ho, because what is obviously best for his client is a dismissal of the charges with prejudice.โ€
