Partner Paul Tuchmann Quoted in the Media Regarding Recent Supreme Court Decisions

Partner Paul Tuchmann has been quoted in Reuters and Law360 regarding recent Supreme Court decisions.

In the Reuters article titled, “Bankman-Fried faces long odds of tossing charges despite Supreme Court decision”, Paul comments on Former FTX Chief Executive Sam Bankman-Fried’s fraud charges relating to the collapse of the bankrupt cryptocurrency exchange. Paul explains that Bankman-Fried has a good chance of convincing Judge Kaplan that the pending bank fraud count he faces rests on the right to control theory and should be dismissed in light of the Supreme Court’s Ciminelli decision last week invalidating that theory.

In the Law360 article titled, “High Court In Graft Cases Warns Courts, DOJ: Don’t Get Cute”, Paul comments on the U.S. Supreme Court’s latest disapproval of an overly expansive use of the wire fraud statute. Paul comments, “You can defraud the government out of property for these purposes, but it’s got to be the same kind of property and the same kind of thing that’s property in the hands of anyone else. You can defraud the government out of a contract, out of cash. But you can’t defraud the government out of … a regulatory decision.”

In the second Law360 article titled, “How Gillum, ComEd Verdicts Might Foreshadow Trump’s Fate”, Paul comments former President Trump’s recent criminal charges. Paul is quoted stating, “It’s going to be more complicated, more novel and not as obvious [of a criminal case] to a jury, but that doesn’t mean it won’t be successful.”
