Summary Judgment Motion Granted for Wiggin and Dana Client Old Dominion Insurance Company
Congratulations to Partner Michael Menapace, who represented Old Dominion Insurance Company in a class action in Florida state court. The plaintiff had alleged that Old Dominion underpaid actual cash value for total losses under its auto policies. The court granted summary judgment for Old Dominion and held that the plaintiff had already released its claim against Old Dominion when it accepted a negotiated amount for the loss. As a result, the plaintiff could not complain now that Old Dominion should have paid it more for title and tag transfer fees.
