Wiggin and Dana Attorneys Prevail In Case for Zurich American Insurance Co.
Congratulations to Wiggin and Dana litigators Michael Menapace, Richard Luedeman, Ivana Greco and Catherine Baiocchi on their victory for Zurich American Insurance Co. in federal court in the Northern District of Illinois.
Plaintiffs brought a putative class action claim against our client under the Medicare Secondary Payor provisions of the Medicaid Act on behalf of certain alleged assignees of Medicare Advantage Organizations. There were multiple unsuccessful attempts to plead a viable cause of action by these Plaintiffs. This time, the Wiggin team moved to dismiss the complaint on standing grounds. The District Court granted the motion and denied leave to replead. In the words of the District Court, “[n]ine attempts to establish standing and plead a cause of action is enough.”
