Wiggin and Dana Obtains Summary Judgment for Zurich American Insurance Company in a Property Insurance Coverage Lawsuit Concerning a Flood Sublimit

Partners Michael Menapace and Robyn Gallagher and Associate Lauren Gambardella recently secured an order for partial summary judgment on behalf of Zurich American Insurance Company in a property insurance dispute involving a flood at a Massachusetts hospital. The federal court agreed with Zurich that the policyโ€™s sublimit for flood applied to water that inundated the buildingsโ€™ roofs before infiltrating and damaging the interior. The Law360 article, โ€œZurich Gets Partial Win In REIT Flood Coverage Disputeโ€ discusses the Massachusetts federal court decision to limit the $265 million thunderstorm damage claim to the policyโ€™s $100 million flood sublimit.
