Wiggin and Dana Obtains Summary Judgment for Zurich American Insurance Company in a Property Insurance Coverage Lawsuit Concerning a Flood Sublimit

Partners Michael Menapace and Robyn Gallagher and Associate Lauren Gambardella recently secured an order for partial summary judgment on behalf of Zurich American Insurance Company in a property insurance dispute involving a flood at a Massachusetts hospital. The federal court agreed with Zurich that the policy’s sublimit for flood applied to water that inundated the buildings’ roofs before infiltrating and damaging the interior. The Law360 article, “Zurich Gets Partial Win In REIT Flood Coverage Dispute” discusses the Massachusetts federal court decision to limit the $265 million thunderstorm damage claim to the policy’s $100 million flood sublimit.
