Wiggin and Dana Secures Win for Zurich American Insurance Company in COVID-19 Business Interruption Case

On September 30, 2022, Wiggin and Dana Counsel Susan Kennedy led a team including Partner Michael Menapace and Associate Leah Mantei in securing a win for Wiggin and Dana’s client Zurich American Insurance Company against orthopedic care provider, The Rothman Institute, in a COVID-19 business interruption insurance coverage case. The Law360 article, “Zurich Slips Orthopedic Institute’s Virus Coverage Suit” discusses the judge’s decision to “toss” the orthopedic provider’s suit against Zurich due to failure of proof of physical loss or damages related to COVID-19 and government shut down.
