Cases involving antitrust claims are being brought with increasing regularity in the franchise and distribution arena. In the first of many antitrust cases decided during the past several months, a federal district court in Pennsylvania held that the claims of two GNC franchisees, brought pursuant to Sections 1 and 2 of the Sherman Act and the Robinson-Patman Act, failed to state a claim and dismissed them pursuant to Federal Rule of Civil Procedure
12(b)(6).
