Partner Dean Fournaris and Counsel Robert Burstein Published an Article on Covid-19’s Effect on Franchise Lost Profits Claims in the Most Recent ABA Franchise Law Journal

In the latest issue of the ABA Franchise Law Journal, Partner Dean Fournaris and Counsel Bob Burstein published an article titled “The Potential Impact of COVID-19 on Franchise Lost Profits Claims.” The article examines how the COVID-19 pandemic has impacted lost profit claims. More specifically, it examines the pandemic’s effect on business operations, and how its impact may cause a sever in the causal chain between a purported breach and the alleged resulting lost profits. As a result a potential defense is provided by overlooking performance or by skewing the calculation of lost profits.
