On June 11, 2022, Partner Maureen Weaver and Counsel Megan George’s article titled, “Health Cos. Can Challenge Medicare Advantage Org Delays,” was published in Law360. The article discusses a recent report from the U.S. Department of Health and Human Services Office of Inspector General. The report, “sparked a call to action to curb questionable tactics that Medicare Advantage organizations deploy under the guise of managing care.”
Maureen and Megan explain, “The April report describes the OIG’s findings that MAOs have used the prior authorization process to deny or delay approvals of services to Medicare Advantage beneficiaries even though the services met Medicare coverage standards.”
The article goes on to explain the OIG’s findings, the American Hospital Association’s call for action, Federal and State reform efforts and options for providers wishing to challenge delays and denials.
