Partner Michael Kasdan Authored an Article for Variety on District Court Ruling in Case Involving Copyrightability of AI-Generated Content

On August 24, 2023, Partner Michael Kasdan authored an article in Variety’s online magazine entitled, “AI-Generated Works Can’t be Copyrighted – Now What?” Mike’s article discusses the recent ruling in Thaler v. Perlmutter, which found that that a piece of art created solely by AI with no human involvement is not eligible for copyright protection. In the article Mike explains, while the court here upheld earlier guidance by the Copyright Office on generative AI, the issue of just how much human creative input is required in order to become copyright-eligible remains an open question.
