Senior Counsel Bob Langer Quoted in The National Law Journal Regarding the Potential CUTPA Implications of Soto v. Bushmaster Decision

Senior Counsel Bob Langer was quoted in the April 2022 edition of The National Law Journal regarding the CUTPA implications of the Soto v. Bushmaster decision. The article originally appeared in the Connecticut Law Tribune on February 25, 2022.

Attorneys for the plaintiffs used the Connecticut Unfair Trade Practices Act to satisfy the predicate exception to the Protection of Lawful Commerce in Arms Act, which provides gunmakers immunity from civil liability for crimes committed by third-parties with their products.

Bob spoke on the impact of the decision, saying, “It has, in my view, extraordinary potential implications for the future.” He goes on to explain that the state Supreme Court’s decision includes at least four important holdings in regards to interpretations of the Connecticut Unfair Trade Practices Act:

  • Eliminates the “commercial relationship” test
  • Provides that “at least with respect to wrongful advertising claims” damages for personal injuries are recoverable under the Connecticut Unfair Trade Practices Act
  • Wrongful conduct up to the time of filing can satisfy the statute of limitations
  • The Connecticut Unfair Trade Practices Act is not always preempted by the Connecticut Product Liability Act
