  • COVID-related litigation:ย COVID-19 has spawned a wide range of employment-related lawsuits raising novel and complex issues that present new and different challenges for employers.ย This segment will explore some of the latest cases raising claims under the ADA and state common law, including wrongful death actions, among other legal theories.
  • Pay Equity and Pay Transparency โ€“ Legislative Updates and Recent Cases:ย Employers are no doubt aware of the recent proliferation of state laws focused on pay equity and enhanced employee access to information about pay.ย ย This segment will review recent salary range disclosure and pay data reporting laws, including recent legislation from New York State, New York City, and Connecticutโ€™s 2021 law.ย ย We will also cover the current state of litigation of equal pay claims and discuss compliance strategies to minimize the risk and exposure of such claims.
  • Wage and Hour Laws: Whatโ€™s new and vexing:ย Compliance with wage and hour laws continues to be a daily challenge for employers across all industries and all jurisdictions.ย This program will discuss the latest developments under the FLSA and state wage and hour laws, including a significant overtime pay case pending before the Supreme Court this term.
  • The Resurgence of Unions and the Biden NLRB:ย The Biden Administration has made no secret of its support for unions and unionization, and with an ambitious and aggressive General Counsel in place the NLRB has been taking steps to implement a pro-worker agenda that is impacting workplaces of all types, including those without union-represented employees. This segment will shed light on, and help you prepare for, the changes we have seen from the NLRB and whatโ€™s coming next.ย We will also discuss the increasing rates of unionization, and how to prepare should an organizing campaign land on your doorstep.
  • The Assault on Restrictive Covenants:ย The past several years have seen an explosion of state laws imposing strict limits on the use of non-competition covenants and curtailing employersโ€™ ability to settle claims and potential claims in confidence.ย This session will explore the latest developments in this rapidly changing area of the law.
