Expect the Unexpected: Contending with Novel Employee Claims

Employers are generally familiar with Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and other civil rights statutes that provide the basis for most routine employment-related litigation. Employers are less familiar with other types of claims, such as negligent hiring and retention, intentional and negligent infliction of emotional distress, invasion of privacy, fraud, unjust enrichment, negligent misrepresentation, and promissory estoppel. This discussion will cover more unconventional claims and some practical advice for avoiding pitfalls that could lead to employee suits alleging something other than discrimination or harassment.
