On January 25, 2013, the United States Department of Health and Human Services (HHS) Office for Civil Rights (OCR) published the long-awaited final HIPAA regulations commonly referred to as the Omnibus Rule. While many of the changes to the HIPAA regulations were expected, the Omnibus Rule will nevertheless require covered entities and business associates to modify their HIPAA policies, procedures and forms. The Omnibus Rule also extends the application of the Security Rule and certain privacy and breach notification obligations to down-stream contractors of business associates.
