2003 Spring Meeting - AIPLA

The Patent Law Committee met on Wednesday, May 14, 2003, at the Spring Meeting in Atlanta, Georgia.
Dale Carlson and Will Slate led a discussion of recent PTO proposals to periodically recertify patent practitioners.  Dale and Will had authored a recent JPTOS article entitled "Are We Certifiable?"  Redux—A Strategic Plan for Maintaning Patent Practice Competence" (April 2003, pp287-300). 
Dale and Will presented an outline of the PTO's original July, 2002 proposal from as well as the revised April, 2003 proposal published on the PTO's website (www.uspto.gov) in Action Paper #44.  The discussion that followed delved into the advantages associated with on-line interactive training, as opposed to a more traditional paper or electronic test.  On-line training would be a particularly effective vehicle for providing periodic updates on PTO practice and procedure changes.
A PTO representative in attendance, James Toupin, indicated that substantial changes were contemplated beyond the April, 2003 proposal, and that there would be a forthcoming notice of proposed rulemaking in the Official Gazette.  The Committee will re-visit the PTO's proposal at that point.
