Attorneys Publish HIPAA Article in TerraLex Connections

Wiggin and Dana attorneys Michelle DeBarge and Jody Erdfarb recently published an article, US State Supreme Court Expands Potential Negligence Liability for HIPAA Violations, in the March 16, 2015 issue of TerraLex Connections.

The Connecticut Supreme Court ruled in Byrne v. Avery Center for Obstetrics and Gynecology, P.C., 2014 WL 5507439 (Conn. Nov. 11, 2014), that a plaintiff may use HIPAA to establish the standard of care in negligence cases. This decision signifies potential expanded liability risk for any domestic or international company that creates, receives, transmits, or maintains health information protected by HIPAA.
