Michael Menapace Quoted in the Hartford Courant

September 3, 2012

Wiggin and Dana insurance attorney Michael Menapace was quoted in a September 1, 2012 Hartford Courant article titled, "'Gibberish' Says Judge in St. Francis Case Insurance Dispute."

The article discusses a case brought before the U.S. District Court for the District of Connecticut in order to determine how to divide costs associated with child abuse claims against St. Francis Hospital and Medical Center. Traveler's argued that a passage within the hospital's insurance policy, called Special Endorsement No. 1, exempts the insurance company from reimbursing the hospital for a portion of its legal expenses. U.S. District Judge Mark R. Kravitz disagreed with Traveler's argument, citing the passage as "gibberish."

In the article, Michael discusses the inclusion of turgid language within insurance policies, commenting that, "Insurers generally want to cover only those risks they are intending to insure."
