Wiggin and Dana Represents Epic Games in Jury Trial Win Against Google in Northern District of California
Wiggin and Dana congratulates its client Epic Games on its jury verdict against Google in the Google Play Store Litigation in the U.S. District Court for the Northern District of California. After a four-week-long trial, the jury deliberated for fewer than three hours before returning a verdict for Epic on every claim it had brought, including that Google engaged in unlawful monopolization, illegal restraints of trade, and tying, in violation of the Sherman Act. Epicโs suit successfully challenged Googleโs anticompetitive conduct in markets for Android app distribution and in-app billing services for digital goods. Wiggin and Dana served alongside co-counsel Cravath, Swaine and Moore, LLP as trial counsel to Epic.
โThis landmark result is a credit to Epicโs courage to bring this litigation and see it through to victory,โ said Benjamin H. Diessel, chair of Wiggin and Danaโs Antitrust and Technology Disputes Practice Group. โIt has been our privilege to serve as trial counsel to Epic.โ Litigation partner Nathan Denning added, โThe juryโs verdict validates Epicโs long-standing commitment to open platforms and fair competition. All Android developers and usersย stand to benefit from Epicโs perseverance.โ
Wiggin and Danaโs Antitrust and Technology Disputes Practice Group routinely represents clients in cutting edge and high profile antitrust and technology related disputes, including leading technology companies, international pharmaceutical companies, manufacturers, hospital systems, startups, franchisors and others.
Diessel and Denning led Wiggin and Danaโs trial team, which also included partners Robert Hoff and Paul Tuchmann, as well as associates Zeynep Aydoฤan, Grace Ronayne, Christopher Bailes, Amanda Gutierrez, Jenna Cutler, and Nestor Rodriguez Smyt.
