Wiggin and Dana Successfully Represented FIH LLC in Two Consolidated Cases in the Connecticut Superior Court’s Complex Litigation Docket
A Wiggin and Dana team led by Partnerย James Glasser and Counsel David Norman-Schiffย successfully represented FIH LLC, in a multi-year, contentious litigation pending on Connecticut Superior Courtโs Complex Litigation Docket. The long-running litigation culminating in a two-week consolidated trial resulting in a complete victory for our client in both cases.
In the first case, FIH asserted claims against Foundation Capital Partners LLC and the Foundationโs Managing Principals for violation of the Connecticut Uniform Securities Act (โCUSAโ), fraudulent misrepresentation, and negligent misrepresentation. In response, claims were brought against FIH by one of the Managing Principals in a separate action alleging violation of the Connecticut Unfair Trade Practices Act (โCUTPAโ). The cases were consolidated for trial. Wiggin and Dana secured a complete victory in both cases on behalf of its client, FIH.ย Wiggin and Danaโs client was awarded complete compensatory damages of nearly $7 million, prejudgment interest of nearly $4 million and attorneysโ fees and costs.
The case creates an important new precedent involving CUSA, which is a rarely litigated statute.
