Robert M. Langer Quoted in Bloomberg BNA's Antitrust & Trade Regulation Report

Wiggin and Dana Antitrust Partner Robert M. Langer was quoted in an article featured in the January 31, 2014 issue of Bloomberg BNA's Antitrust & Trade Regulation Report (ATRR) titled, "FTAIA Bars Motorola Mobility's §1 Claims for Foreign Purchases of TFT-LCD Panels." Mr. Langer has served as a member of the advisory board of ATRR since joining Wiggin and Dana in 1994.

The article discusses the U.S. District Court for the Northern District of Illinois' recent decision to grant summary judgment to AU Optronics and other makers of TFT-LCD panels against foreign injury claims brought by Motorola Mobility Inc. under the Foreign Trade Antitrust Improvements Act (FTAIA).

Mr. Langer commented on the case, emphasizing that, "this case again demonstrates the Leibnizian complexity involved in parsing the language of the FTAIA."

Mr. Langer observed, "Courts do the best they can under the circumstances, but Congress should address the issue and clarify the extraterritorial reach of the U.S. antitrust laws."
