Wiggin and Dana Partner Quoted in Antitrust & Trade Regulation Report

Wiggin and Dana Litigation Partner, Robert Langer, was quoted in an article featured in Bloomberg BNA's Antitrust & Trade Regulation Report titled, "Parker Doctrine Won't Cloak Phoebe Putney: Supreme Court Revives FTC's Merger Attack." The article discusses the Supreme Court's recent holding that Phoebe Putney Hospital System's acquisition of its only rival hospital in Dougherty County, GA was subject to the federal antitrust laws and not immune from scruntiny under the state action immunity doctrine.

In his quotation, Mr. Langer invoked baseball legend Yogi Berra with the remark that the Court's Phoebe Putney decison "seems like déjà vu all over again." Mr. Langer pointed to FTC v. Ticor Title Ins. Co., 504 U. S. 621 (1992) commenting that, "over 20 years ago, the states collectively asserted as amici curiae that "that the state action immunity doctrine ha[d] been stretched beyond its appropriate limits.
