NLRB Again Extends Deadline for Posting Notice of Employee’s Rights Under the National Labor Relations Act
The National Labor Relations Board (“NLRB”) has once again extended the deadline for private-sector employers subject to the NLRB’s jurisdiction to comply with a Final Rule requiring them to post a notice informing employees of their rights under the National Labor Relations Act. The deadline to comply is now April 30, 2012. The deadline change was prompted by a request from the federal district court Judge in Washington D.C. who is presiding over two consolidated legal challenges to the validity of the rule. At oral argument held on December 19, 2011, the judge indicated that she would not be in a position to render a decision before the current January 31 compliance deadline, and requested that the NLRB delay implementation of this rule to provide her additional time to render a decision on these challenges. We will continue to monitor the Washington D.C. case, as well as similar litigation pending in South Carolina, and provide you with updates as developments warrant.
