Known for practical, cost-effective adviceโ€”whether itโ€™s to fight for a trial victory or seize an early, advantageous resolutionโ€”Robert is dedicated to aggressively representing companies and individuals in complex government investigations and commercial litigations. A Partner in the firm’s Litigation Department and White Collar Defense, Investigations and Corporate Compliance Practice Group, Robert also co-chairs the Auditor and Accountant Liability Defense Practice Group and leads the firmโ€™s eDiscovery and Electronic Data Practice Group.

Robert represents companies and individuals in civil and criminal matters before entities such as the U.S. Department of Justice, the Securities and Exchange Commission, the Public Company Accounting Oversight Board (PCAOB), state Boards of Accountancy, the Commodity Futures Trading Commission, the Internal Revenue Service, and state Attorneys General. In addition to his white collar work, Robert represents companies and individuals in diverse civil litigations in federal and state courts across the country.ย 

Client matters have involved the manufacturing, marketing, and sale of opioids, auditor malpractice, insider trading, subprime mortgages and mortgage-backed securities, antitrust, stock options backdating, bribery, securities fraud, and high-stakes commercial disputes, among others. Robert has also conducted numerous internal investigations. Robertโ€™s eDiscovery work focuses on providing clients with comprehensive, defensible eDiscovery services at reasonable cost.

Among other recent engagements, Robert

  • Plays a key role in the national coordination of litigations and investigations involving a pharmaceutical company’s manufacturing, marketing, and sale of opioid medications.
  • Secured a favorable resolution for a life sciences client in a dispute with a pharmaceutical company over entitlement to a milestone payment triggered by the progress of clinical trials.
  • Led an internal investigation at an international bank concerning the conduct around a large bond underwriting deal.
  • Led an internal investigation involving a nonprofit agency that had been the victim of embezzlement. Robert secured a complete insurance recovery for his client and steered the client through a federal investigation.
  • Won an arbitration for an investment advisor whose departing partner challenged his compensation.
  • Successfully defended a Big Four auditor from PCAOB charges of improper documentation practices.
  • Achieved a significant victory on summary judgment that led to a favorable resolution for a venture capital fund in a dispute with a former member.
  • Represented an individual in a DOJ and SEC investigation concerning cryptocurrencies.
  • Assisted a client in reaching a favorable resolution pre-litigation concerning a dispute over the launch and sale of digital assets.
  • Represents an international business that manufacturers technical parts for aircraft in an intellectual property dispute.

Robert graduatedย magna cum laudeย from Brooklyn Law School, where he was a Prince Merit Scholar and an associate editor at theย Brooklyn Law Review. He was also a member of the moot court team that won first prize in the National First Amendment Moot Court Competition. Robert received his B.A. in political science from Binghamton University.ย 

Following law school, Robert clerked for the Honorable Robert J. Ward in the U.S. District Court, Southern District of New York. Before joining Wiggin and Dana, Robert worked at a large international law firm, where he practiced in the areas of securities litigation, commercial litigation, and white collar defense and investigations.

Robert has served on the boards of local charities and his synagogue and plays drums for a traveling rock and roll band. He is also committed to pro bono appellate and trial work for indigent defendants.
